BOARD OF SUPERVISORS Tuesday, April 13, 2004 All Supervisors present. RENAMING OF A SECTION OF RT. 151 - Supervisors voted 5-0 to adopt a resolution requesting that VDOT rename the section of Rt. 151 (from 0.390 kilometer south of Rt. 709 to 0.244 kilometer north of Rt. 709) in memory of the late Senator Emily Couric. PRESENTATIONS - Supervisors presented resolutions and plaques honoring Mr. Robert Harlow, Mr. Bobby Brush and Mr. Lebron Drumheller for their many years of service on the Planning Commission. SHIPMAN POLLING PLACE - Mr. Mike Crabill reported that the Accessibility Coordinator for the State Election Board had refused to issue a waiver to the handicap-access requirements for the Shipman Community Center for the one-time use of the building for the November, 2004 election. Mr. Crabill noted that the building could meet the requirements by adding a temporary ramp, reworking the main door and paving the required area for handicapped parking. He asked for direction from the Board as to how to proceed. Mr. Crabill reported that the other option would be use of Woodland Baptist Church, which would meet the handicap-access requirements but would not be as well located for the residents. Mr. Harris agreed to continue working with the County Administrator to find the best solution. Mr. Crabill then reported that the county would soon be required to purchase at least one new voting machine per polling place. The new machine will be an optical scan machine to allow handicapped voters to vote without assistance. He noted that federal funds in the amount of $4,250 per polling place would be available with machines costing between $3,000 and $4,300 each. MONTEBELLO BIRD SACTUARY - Supervisors voted 5-0 to direct staff to advertise a public hearing to adopt an ordinance to establish a Bird Sanctuary beginning at the intersection of Rt. 56 and North Fork Road (Rt. 687) and continuing up Rt. 56 to the intersection of Rt. 56 and the Blue Ridge Parkway. VDOT SIX-YEAR PLAN (SECONDARY ROADS) - Supervisors adopted the proposed plan and agreed to schedule a public hearing on the proposed Rural Rustic Roads in May. DRAFT ZONING ORDINANCE - As a follow-up to the earlier Zoning Session, Mr. Carter suggested that Mr. Cox could review the remaining districts and balance of the ordinance in three sessions. He noted that he thought staff could have at least a tentative zoning map ready for that session. Supervisors asked that that session be scheduled as soon as possible, that the review be condensed into one session and then the Board could proceed to a Public Hearing. Mr. Wood clarified that the intent is to adopt the ordinance and to then work to make amendments over the next several months. APPOINTMENTS - Supervisors voted 5-0 to appoint Mr. Steve Alderfer to the Nelson County Recreation Department Advisory Board. BOARD DIRECTIVES - Ms. Brennan expressed appreciation to Delegate Watkins Abbitt and Lee and Paulette Albright for their work in reopening the Montebello Fish Hatchery to visitors. CLOSED SESSION - To consult with counsel on probable litigation and to discuss a prospective business. EVENING SESSION (Mr. Harvey absent) - PRELIMINARY SUBDIVISION PLAT/MARCKEL - Supervisors voted 4-0 to approve a preliminary plat to divide approximately 25.51 acres of land on Hedge Lane off Rt. 151 into 3 parcels (4 acres; 4.56 acres and 18.94 acres). The approval granted an exception from upgrading Hedge Lane to County Road Standards but will include a note on the plat that no building or zoning permit can be issued until the road is brought up to standards. WATER AND WASTEWATER ORDINANCE - Supervisors reviewed the proposed ordinance detailing the conditions, policies and rates applicable to all county-owned systems (which would include Piney River Phase III and the Henderson's Store system). The ordinance set the rates at $21.20/month for water and $25.74/month for sewer for up to 4,000 gallons. In addition, there will be a $4.50/month grinder pump fee. Non-user fees (for those who are within the service area but do not hookup to the system) were set at $16.90/month for water and $15.35/month for sewer. The ordinance also set rates for other administrative fees and connection fees. Connection fees will be waived for those in the Piney River Phase III area during the project period. Supervisors voted 4-0 to adopt the ordinance with rates to go into effect July 1, 2006 (the estimated completion date for Piney River Phase III). The adoption of the ordinance at this time will assist in the completion of the grant funding application process.
