BOARD OF SUPERVISORS' ZONING WORK SESSION Tuesday, May 11, 2004 Present: Ms. Brennan, Mr. Wood, Mr. Harvey, Mr. Harris (Consultant: Mr. Frank Cox; Staff: Ms. Susan Rorrer, Mr. Fred Boger and Mr. Steve Carter) Absent: Mr. Bruguiere Mr. Cox reviewed the different districts detailed in the draft ordinance: RURAL AND RESIDENTIAL: Rural & Farming District Rural Residential Village District Neighborhood Residential District Attached & Multifamily District COMMERCIAL AND BUSINESS: Neighborhood Business District (Mr. Cox suggested the name might be clearer if changed to "Mixed Use District") Town Center District Planned Shopping Business District ECONOMIC DEVELOPMENT: Light Industrial District Heavy Industrial District SPECIAL OVERLAYS: Planned Community Development District Corridor Overlay District Floodplain Overlay District He noted that the Rural & Farming and Rural Residential Districts would be the lowest density districts with the Neighborhood Residential District being designed for single family homes at 3 units per acre. The Attached & Multifamily District would have special provisions to encourage development of housing for elderly and assisted living, as well as allow sufficient density to make development there profitable. Mr. Cox explained the Neighborhood Business District (or Mixed Use District) as residential plus smaller retail establishments and gave Nellysford as an example of a Town Center District. He said that the Planned Shopping Business District was written to deal with future pressures for freestanding shopping centers, noting that if a highway-oriented shopping center were proposed, the District would provide a tool to govern the details. He noted several areas designed Light Industrial in the county and two Heavy Industrial areas (on Rt. 151 near the Amherst County line and on south 29 at the truck stop and lumber mill. Mr. Cox said that the Planned Community Development District would allow the county to consider larger development in areas not previously considered and give the county controls on the location and development of the site. He said that the Corridor Overlay District would add an extra layer of oversight to key corridors and ensure some ability to legislate taste along major tourism routes. He noted that the review board for those regulations could be an offshoot of the Planning Commission but that the Board of Supervisors would determine what details of the development would be regulated. The Floodplain Overlay District is determined by the FEMA maps. Following Mr. Cox's review of the districts, Mr. Boger presented the draft zoning map. (NOTE: Rural Nelson will post the map on their website as soon as possible.) The map shows areas that are designated rather than individual parcels of land. Wintergreen is showed as a Planned Community with areas designated for Rural Residential in Arrington, Shipman, along Rt. 6 West, and at various places along Rt. 151. Neighborhood Residential, Neighborhood Business and Town Centers are shown at Schuyler, Nellysford and Lovingston. Light Industrial is designated for areas where there are currently Industrial Parks or existing industry. There are no designated areas for Planned Shopping Districts at present. Route 29 and Rt. 151 are shown as Corridor Overlays and the existing Ag/Forestal District in Elma is also denoted. The bulk of the county is shown as Rural & Farming District. Following Mr. Boger's review of the map, Mr. Cox noted that the county would still have to go through the tax maps parcel by parcel with each parcel identified by zoning district. Mr. Harris pointed out that the areas already designated would not accommodate everything called for in the future and said that rezonings would be required along the way. He also said that the map did not show Rural Residential areas with existing businesses. Mr. Boger said that staff would be going back to look at areas that should be Mixed Use District. Ms. Brennan asked about adding additional routes to the Corridor Overlay Districts - besides Rt. 29 and Rt. 151. Supervisors agreed by consensus to add Corridor Overlay Districts to Rt. 56W and E, Rt. 664, Rt. 6W & E, and Rt. 60. Mr. Cox suggested the Board consider adding an Historic District to the ordinance to avoid having to later amend the ordinance if the county later decided to designate an area. He noted that added the District to the ordinance would only make it available for future use if desired. Supervisors agreed by consensus. Mr. Cox then suggested that the Board consider changing the density in Rural Residential from the draft conventional subdivision at 1 unit per 6 acres and cluster subdivision at 1 unit per 3 acres to 1 unit per 5 acres for conventional and 1 unit per 2 acres for cluster to encourage development in Rural Residential areas rather than Rural & Farming. In cluster development, Mr. Cox suggested that the open space parcel should also have one development right so the owner could build and live on that parcel. Supervisors agreed by consensus. Under Rural & Farming, Supervisors agreed by consensus to change the maximum lot size for a cluster subdivision lot from 3 acres to 5 acres, with the minimum lot size remaining at 1.5 acres. Ms. Brennan asked whether the county was ready to advertise for public hearing. Mr. Carter said that the staff and Mr. Cox would need a few days to review and put all the pieces in place before advertising a public hearing for sometime in June.
