BOARD OF SUPERVISORS Tuesday, July 13, 2004 All Supervisors present. RECYCLING/SOLID WASTE - Ms. Paulette Albright, representing Keep Nelson Beautiful, asked that the Board consider the recycling program at the schools when negotiating the new solid waste contract. She presented a KNB report on the program in the schools with recommendations, noting that as a public entity, schools should be recycling. Ms. Albright suggested that a system-wide recycling program is needed. VDOT REPORT - Mr. Kevin Wright reported that the county's Six-Year Plan funds had been used to repay VDOT $317,291 due for the Industrial Access Road at Colleen Industrial Park. He said that the repayment had had no impact on the first four road priorities in the Plan with the delays coming in priorities 5-9. He noted no effect on the roads identified for the Rural Rustic Roads program. NELSON SENIOR PROGRAMS - Mr. Pete Perdue, representing the seniors of the Rockfish Valley Community Center, detailed the number of seniors meeting at four Nelson locations - Gladstone, Schuyler, RVCC and the Nelson Senior Center. He said that the seniors did not want to travel to the Nelson Center for two reasons - 1) amount of time and cost of trip and 2) prefer the kinship of small, local group. He noted the disparity in available transportation to the Nelson Center with only RVCC and the Nelson Center seniors being provided free transportation - Gladstone and Schuyler having no free transportation to the Nelson Center. Mr. Perdue asked that the Board fund the RVCC program at $5.00/senior/week for 44 weeks for a total of $24,640. Mr. Wood said that further discussion is needed on the senior programs, discussion that would include the big picture and outlying areas currently not served at all. ROCKFISH VALLEY COMMUNITY CENTER - Ms. Ellen Neal presented an overview of activities over the past five years, including programs for youth and seniors, technology, space for non-profits and classes. She estimated that volunteer labor and materials had provided $67,500 in building improvements over that time period. Ms. Neal requested four things: 1. Permission to proceed with the identified 2004 capital improvement projects - - roof repairs; - boiler repairs; - removal of asbestos in two basements; - hydro-system maintenance 2. Inclusion of the proposed Community Center definition into the Zoning Ordinance to allow the Center to be self-supporting 3. Conveyance of the facility for $1.00 4. Relief from real estate taxes (building assessed at $700,000). Supervisors agreed to discuss the transfer of the building and directed staff to pull the other similar contacts to determine what others had paid. Mr. Wood said that the Board has and will discuss the real estate tax relief issue. Supervisors voted 5-0 to authorize RVCC to proceed with the capital improvement projects as identified above. COUNTY WEBSITE - Ms. Maureen Corum, Director of Economic Development and Tourism, presented information on the new county website noting the search capabilities, the ability of each department to update their pages and other user-friendly features. Ms. Brennan asked that each Supervisor have a county email address. GATEWAY SIGNS - Supervisors voted 5-0 to adopt gateway signs at six entrances to Nelson County in order to provide insurance under the county's blanket coverage. The Industrial Development Authority will be responsible for the maintenance and upkeep of the signs. COUNTY EMPLOYEE SALARY & CLASSIFICATION - Mr. Carter presented a resolution to authorize a 6% salary adjustment for county personnel. Following Mr. Harvey's motion to adopt the resolution, Mr. Wood said that he would vote no as a straight 6% increase would skew the scale system. He said he would prefer to do an increase with one step. Mr. Harris and Ms. Brennan said that they would vote yes, but somewhat shared Mr. Wood's view. Ms. Brennan said that the issue needed further discussion for future increases. Supervisors voted 4-1 (Mr. Wood voting no). SCHOOL NURSE SALARIES - Mr. Harris said that the Board had planned to give the School Nurses the same increase as county employees and had set that increase at 5%. He said that now the county employees would receive 6%. Supervisors voted 5-0 to give School Nurses a 6% total increase. SOLID WASTE UPDATE - Mr. Carter reported that the advertisement for bids for the Rt. 151/Ruritan Park site would appear in this week's paper with the bid conference scheduled for 7/22 at 1pm and the bids due 7/30 at 3pm. He asked for comments on KNB's recommendations regarding a school recycling program, noting the little recycling done in the past school year. Mr. Wood said that if there were any hope for less trash in the future, there should be a recycling program in the schools. Ms. Brennan and Mr. Harris agreed to meet with two members of the School Board to see what the problems are and to get their suggestions for a program. Further discussion tabled pending that report. RYAN SCHOOL PROJECT - Mr. Carter reported that the Rural Development funding had not been awarded for the project. He said that the RD funding was a critical part of the project but that other possible funding sources had been identified for the approximately $1million needed to complete the project. Mr. Carter said that he is still optimistic. He said that he had talked with Mr. George Krieger with Nelson County Community Development Foundation about possibly using some future HOME funds for the project. Mr. Harris said that the HOME funds are used to assist the needy in the county and that he hoped that option would be the last choice. Mr. Wood said that he would prefer to look at a commitment from the General Fund if the Board feels the project is important rather than diverting funds from the HOME program. Further discussion tabled. APPOINTMENTS - Supervisors voted unanimously on the following: Central District representative/Welfare Board - Mr. Frank Wood East District representative/Library Advisory Board - Ms. Nancy Kritzer Board of Zoning Appeals (recommendation to Circuit Court Judge) - Ms. Kim Cash In addition, Supervisors voted 5-0 to established a Courthouse Project Committee as an advisory group for the Board as follows: Supervisor - Connie Brennan Judge - Judge Serkes Judge - Judge Gamble Clerk - Ms. Judy Smythers County Administrator - Mr. Steve Carter Citizen - (position to be advertised) Citizen - (position to be advertised) Member/Historical Society - request for recommendation to be made to Historical Society CLOSED SESSION - to discuss a specific legal matter with counsel. CONDITIONAL USE PERMIT/NELSON COUNTY RESCUE SQUAD - Applicant requests a permit to construct a helicopter landing pad at their new site (to be constructed) on Rt. 29 south of the AEP facility. With no Public Comment, Supervisors voted 5-0 to approve the permit. AMENDMENT TO SECTION 7-33.1 OF CHAPTER 7, ARTICLE 11 OF THE CODE OF NELSON COUNTY - With no Public Comment, Supervisors voted 5-0 to amend the Code to require payment of all delinquent motor vehicle personal property taxes prior to the issuance of a vehicle license. REZONING & MASTER PLAN AMENDMENT/HIGH COUNTRY ASSOCIATES - STONEY CREEK - Mr. Boger said that after consultation with the County Attorney, the county had not met the legal advertisement requirements for the application. He reported that the conventional rezoning request had turned into a request for a conditional rezoning with the addition of the proffers. Mr. Boger said that the advertisement should have been for a conditional rezoning with the proffers detailed in the advertisement to meet the legal requirements. He said that the Board would need to send the application back to the Planning Commission to begin the process again. Mr. Dick Carroll, representing High Country Associates, asked to withdrawal the application and requested Mr. Boger's assistance in preparing the proper application. Mr. Wood apologized for the misunderstanding but said that it would be best legally to withdrawal and submit the correct application. PUBLIC COMMENT - Mr. Peter Agelasto, representing Friends of the Rockfish Watershed, said that grant funding is available to the Nelson County Service Authority to enable the county to do water studies. He noted that many of the ongoing issues facing the county involve water and studies could assist in those decisions. He encouraged the county and the NCSA to consider applying for funding for those studies. Meeting continued to Thursday, August 5 at 5:00pm. Following a work session, Supervisors will meet with the Industrial Development Authority at 6:00pm. ------------------------------------------------------------------------ OF INTEREST: - Thursday, July 15 - The 9th annual Nelson County School and Community Health Fair will be held at the High School-Middle School complex from 3:00 until 7:00 P.M. People of all ages are encouraged to attend. Over $500 worth of free screenings can be obtained that day. Many informative exhibits, door prizes, a raffle, and giveaways will all be part of the event. Student Athletes can receive their sports physicals beginning at 6:00 PM, but must have previously turned in the form or bring a parent to the event.
