FINAL SUBDIVISION PLAT/BEAVER CREEK - Mr. & Mrs. Robert G. Macionis submitted a final plat to divide 43.76 acres into 8 parcels ranging in size from 2.85 acres to 10.70 acres. The property is located on Hunting Lodge Road (Rt. 646). With no public comment, Commissioners voted 6-0 to recommend approval. PRELIMINARY & FINAL SUBDIVISION PLAT/MICHAEL & SALLY DONOVAN - Applicants submitted a plat for a 10.98 acre division, leaving a 42.2-acre residue parcel. The property is located on Blundell Hollow Road. The applicants had previously (2004) divided 43.76 acres into 8 lots. During Public Comment, Mr. Ray LaFalce, an adjoining landowner, said that he would not like to see the 10 acres divided again into smaller lots. He said that there would be future problems with water and septic systems, noting that the lots border on the creek that runs across his property. Ms. Donovan reported to the Commissioners that the covenants on the lots do not allow for further division. She noted that all soils work has been done and approved and that the subdivision has been all TJSWCD requirements. Commissioners voted 6-0 to recommend approval of the plat. REZONING REQUEST/ANDERSON'S STORE/MR. CURTIS BRUGUIERE - Postponed until May 25th meeting. SITE PLAN/NELSON COUNTY HIGH SCHOOL PARKING LOTS - Dr. Roger Collins reported that he and Mr. Bruguiere had met with VDOT to explore options for correcting the existing drainage problems at the school (related to the previous construction project). He noted that the drainage problems on Drumheller Lane have been addressed with the installation of a ditch to handle the runoff. Mr. Glenn Curtis, representing Draper Aden Associates, noted three identified options for dealing with the drainage issues: 1. installation of an underground retention system under the parking lot (behind the school); 2. improvements to the culvert and ditch to create adequate capacity; or 3. installation of a pipe to take the runoff down Drumheller Lane. Mr. Curtis said that his firm, along with the school staff, will develop the costs for each option and work with VDOT to get approval. Dr. Collins noted that the paving project costs are at $357,000 plus the costs for the drainage mitigation work. He noted the School Board's contingency on the bid that a decision must be made on acceptance by May 1st. He said that the School Board could ask the contractor to extend the time period or the project could go to bid again. Ms. Russell said that she would prefer to have the applicant work with VDOT and TJSWCD to develop a plan before the Commission approves the site plan. She noted, however, that the Commission is being asked to approve a site plan and not a plan for the amelioration of the existing drainage problems. Mr. Boger noted that the Commission could require a performance bond as allowed by ordinance, in addition to the E&S bond. After discussion, Commissioners voted 6-0 to approve the site plan dated April 16, 2004 for the parking lots subject to the following: approval by VDOT and TJSWCD of the amelioration of the existing drainage problems and the posting of a performance bond with the Planning Department to guarantee completion of the selected amelioration solution. SITE PLAN/LIGMINCHA INSTITUTE - Mr. Massie Saunders, representing the applicant, presented a site plan for Phase II. Plans call for an additional guest house wing, kitchen and dining area. In addition, future construction would include a mezzanine and offices/classrooms/bookstore as well as additional parking spaces. The property is located on State Rt. 714. Mr. Boger noted that Health Department and E&S approvals are still pending. Mr. Saunders noted that the original septic system was installed with full development of the plan in mind and that the system is being evaluated now to verify the capacity. Commissioners voted 6-0 to approve the site plan contingent on Health Department and E&S approvals. Ms. Russell requested that the applicant submit a final lighting plan to Mr. Boger for approval. REGIONAL HAZARD MITIGATION PLAN - Mr. Bill Wanner with Thomas Jefferson Planning District Commission, presented the Plan, noting that the intention is to meet FEMA's new planning requirements. He said that the plan assesses the county's possible scenarios for disasters and the county's ability to deal with those disasters. He noted flooding as the top potential disaster for Nelson with major storms as the second highest possibility. Mr. Wanner said that, as part of the plan, TJPDC has submitted a grant application to update Nelson's floodplain maps. Commissioners agreed to hold a public hearing on the Plan at their regular May 25th meeting, which they changed to 7:00pm due to a heavy agenda. (NOTE: Copies of the Regional Hazard Mitigation Plan will be available in the Planning Department, Nelson Library and on the county's website prior to the May 25th hearing.)
