OTHA M. RAGLAND, JR. & MS. BETTY R. PARRISH - Withdrawn by applicant. CONDITIONAL USE PERMIT/MR. RILEY JONES - Postponed at the request of the applicant. SITE PLAN/NELSON COUNTY FARM BUREAU - Mr. Massie Saunders, representing the applicant has submitted a site plan for the Farm Bureau's new office building to be located on 1.630 acres at 978 Front Street in Lovingston. The two-story building will contain approximately 3,100 sq ft of office space. Mr. Boger reported that the E&S Plan is under review, VDOT has approved the entrance and lighting, signage and landscaping plans have been submitted. He noted that the sign, which meets the ordinance size requirements (50 square feet in size), is not appropriate for the Lovingston Historic District although there are no architectural review regulations to require a different sign. Mr. Saunders noted that the sign will be illuminated internally and will be set to turn off at 9pm each evening. With no public comment, Commissioners voted 4-1 (Ms. Hunt voting no) to approve the site plan contingent on final approval of the E&S Plan and submission of a final sign plan for the files. Ms. Hunt noted that too much information was submitted just before this meeting to allow time for review. EXCEPTIONS TO SETBACK REQUIREMENTS/MR. ALLEN YOHO - The applicant has applied for an exception pursuant to Section 7-1 of the Subdivision Ordinance to build an addition to his home at 299 Lakeland Lane in Faber. Mr. Boger reported that the 100-foot setback required by the developer when the Lakeland Subdivision was approved is more restrictive than the county's required setback. He said that he has received a letter from The Lakeland Property Owners Association noting unanimous approval of the remodeling plans and waiving the 100-foot setback as stipulated in their covenants. Mr. Harvey verified that the requested exception affects the setback from the road and not from adjoining property. With no public comment, Commissioners voted 5-0 to recommend approval of the exception. FINAL SUBDIVISION PLAT/FERNSIDE - Mr. Gillies Rodgers has submitted a final plat to divide 35.86 acres into 8 lots ranging in size from 2.274 acres to 10.894 acres for property located on James River Road (Rt. 56) and Deer Run Lane (Rt. 648). With no public comment, Commissioners voted 5-0 to recommend approval of the final plat contingent on final approval of the E&S plan. PROPOSED ZONING ORDINANCE AMENDMENT/WINE TASTING ROOMS - Mr. Boger presented another option for the proposed amendment that includes a definition of "Farm Winery" and "Farm Winery Permanent Remote Retail Establishment". After review, Commissioners directed staff to add wording, "and in compliance with State Building Code" to the requirement that other food served on the site shall be prepared at a food establishment licensed as necessary by the Virginia Department of Health. In addition, Commissioners directed staff to add a "Farm Winery" as a by-right use in the Agricultural District and a "Farm Winery Permanent Remote Retail Establishment" as a Use Allowed by Special Use Permit in Agricultural; Business and Service Enterprise Districts.
