Individual Septic Systems and PROPOSED AMENDMENT TO ZONING ORDINANCE Section 12-1 Zoning Permits. After review of the draft language; comments from the public, a surveyor, an AOSE (Authorized On-Site Soil Evaluator), and a representative from the county Health Department, Commissioners directed staff to prepare a draft for review at their July 23rd meeting as follows (Note: exact text of the staff-prepared draft may vary from the following but the intent and proposed regulations are below): NELSON COUNTY SUBDIVISION ORDINANCE: 4-4 Water and Sewer. D. Individual Septic Systems. No subdivision shall be approved where individual septic systems are to be used until written approval has been secured from the Health Department. In order to grant approval, an AOSE shall determine the suitability of soil for use of septic systems with on-site sewage disposal systems and file his report with the Planning Director who will forward to the Health Department for review and approval. 1. Any subdivision approved after ___________ shall have an approved site for a septic system and reserve area. 2. In all zoning districts, the reserve on-site septic system area shall be sufficient to accommodate a minimum one hundred (100) percent of the capacity of the initial on-site septic system. 3. Exceptions to the above provisions: a. Family subdivision b. A Residue lot as defined herein and of 20 acres or more, provided the following statement is placed on the face of the plat: "Approval of this subdivision plat by the County of Nelson does not certify or guarantee that the soils on this property will support a septic system for the purposes of the subdivision (whether residential, commercial, or industrial) as no demonstration has been made by the property owner, developer or purchaser." E. Alternative Waste Treatment Systems. 2. In all zoning districts, the reserve for an alternative waste treatment system area shall be sufficient to accommodate a minimum of one hundred (100) percent of the capacity of the initial on-site system. NELSON COUNTY ZONING ORDINANCE: 12-1 Zoning Permits. (d) Where an individual septic system is to be used, the owner/agent must submit either a bare application (wherein the Health Department representative will do the required site evaluation to issue a sewage disposal system construction permit), or an AOSE (Authorized On-Site Soil Evaluator) application for the lot. The soils work for either type of application shall show the primary drainfield area together with a reserve area equal to a minimum of one hundred (100) percent capacity of the primary drainfield. (e) Where an alternative waste treatment system is to be used, documentation must be submitted showing that the system has been approved by the Health Department and that the reserve area for this system shall be Sufficient to accommodate a minimum of one hundred (100) percent of The capacity of the initial on-site system. Note: "Residue" as defined in the Subdivision Ordinance - "The part of an original lot remaining after a portion has been divided off pursuant to Appendix B of the Code of Nelson County as amended. The residue shall be identified as one of the lots within the subdivision. For example, for a two-acre parcel divided off a six-acre parcel, the new lot is identified as one parcel and the residue is the second parcel." Meeting adjourned.
